General Terms and Conditions

1. Scope of application

The General Terms and Conditions (hereinafter referred to as “GTC”) apply to orders placed and contracts concluded via the Actiwa Swiss Group AG online store. The online store reserves the right to amend the GTC. The version of the GTC valid at the time of the order shall apply, which cannot be changed unilaterally for this order.

2. Offer

The offer is aimed at customers resident in Switzerland or Liechtenstein. Deliveries are only made to addresses in Switzerland or Liechtenstein. The offer is valid as long as it is visible in the online store and/or stocks last. Prices and product ranges are subject to change at any time. The images shown in advertising, brochures, the online store, etc. are for illustrative purposes only and are not binding.

3. Order

The presentation of the products in the online store is not a legally binding application, but a non-binding online catalog or a non-binding invitation to customers to order the product and/or service in the online store. An order is deemed to be an offer to the online store to conclude a contract. After submitting the order, the customer automatically receives a confirmation of receipt, which documents that the order has been received by the online store. After receiving this confirmation of receipt, the customer can no longer change the order and is bound by it. The online store is free to refuse orders in whole or in part without stating reasons. In this case, the customer will be informed and any payments already made will be refunded. Further claims are excluded. Products that are temporarily out of stock cannot be reserved.

4. Conclusion of contract

A contract is only concluded when the ordered products are dispatched or the delivery date is agreed. As soon as the order has been dispatched, the customer will be informed by e-mail. However, if the subject matter of the contract is a custom-made product or a special order, the contract is concluded upon written acceptance of the order by the online store.

5. Price

Prices are quoted in Swiss francs, including value added tax (VAT).The price in the online store at the time of the order is decisive.

6. Payment options

Payments must be made in Swiss francs.

Electronic means of payment: The electronic means of payment offered in the store are accepted.If payment is made by credit card, the amount will be debited after the goods have been dispatched.

Purchase on account: The online store may offer payment on account at its own discretion.The invoice amount must be paid directly within 10 calendar days of the invoice date. The online store may, at its own discretion, require payment in advance. In the case of prepayment, delivery will not be made until payment has been received. The ordered products are not reserved until payment has been received and may be out of stock in the meantime.

7. Retention of title

Ordered products remain the property of the online store until full payment has been received.

8. Delivery

The delivery address must be in Switzerland or Liechtenstein. Delivery is ex warehouse. The stated deadlines and dates are non-binding.In exceptional cases, the delivery of the ordered number of items can be divided into several partial deliveries. If products are delivered with obvious damage to the packaging or contents, the customer must immediately complain to the service provider (e.g. forwarding agent, post office) and refuse acceptance, without prejudice to their warranty rights.It is the customer's responsibility to check the ordered products immediately upon receipt and to complain in writing to the online store about any defects or deviations from the order within 14 calendar days.The customer is obliged to obtain a confirmation of damage from the service provider (e.g. forwarding agent, post office).
All transport damage must also be reported immediately to the online store. If the customer does not accept the ordered products, the online store may charge the customer for the delivery costs and expenses incurred and reserves the right to withdraw from the contract. The delivery costs are shown separately in the shopping cart, in addition to the price of the products ordered.

9. Return policy

We offer a 100% satisfaction guarantee. Returns are possible within 30 calendar days from the date of the postmark or confirmation of delivery or receipt. If the customer cannot produce the delivery or receipt confirmation, the 30-day period begins from the date of dispatch of the order. The product must be returned in its original packaging, undamaged, clean and complete. The costs for the return are to be borne by the customer.
If the customer returns the product as described above, the payment already made will be refunded.

10. Data protection

The online store points out that the data recorded during the conclusion of the contract is collected, processed and used to fulfill the obligation arising from the purchase contract.The data required for the provision of services and fulfillment of the contract may also be passed on to contracted service partners (e.g. logistics companies, service partners, debt collection companies), including abroad in countries that may not have an equivalent level of data protection.By agreeing to these GTC, the customer agrees to this use of data.

11. Applicable law and place of jurisdiction
The legal relationship between the online store and the customer is governed by Swiss law, to the exclusion of conflict-of-law rules and the Vienna Sales Convention. The place of jurisdiction for natural persons is Muri or the customer's place of residence. For legal entities, Muri is the exclusive place of jurisdiction.
